Common questions
General information only. Your situation is specific, so please speak with a lawyer about your circumstances.
A family lawyer advises on the legal issues that arise when a relationship ends or a family changes, including divorce, parenting arrangements, child and spousal support, dividing property, and separation or marriage agreements. A lawyer can explain your rights, help you negotiate, prepare and file court documents, and represent you in court if it becomes necessary.
Ideally before you make major decisions, such as moving out, signing an agreement or agreeing to a parenting schedule. Early advice helps you understand your rights and obligations, and strict time limits can apply to some claims. It is also wise to call if your spouse has already hired a lawyer, if children are involved, or if you are worried about your safety.
A divorce application is filed with the Ontario Superior Court of Justice under the federal Divorce Act. At least one spouse must have lived in Ontario for at least one year before filing, and you must show that the marriage has broken down, most often because you have lived separate and apart for at least a year. You can apply on your own or jointly with your spouse, and a lawyer can prepare the documents and file them for you.
Parenting decisions are guided by the best interests of the child. Under the Divorce Act, the terms parenting time and decision-making responsibility have replaced custody and access. Many parents agree on arrangements through negotiation, mediation or a written parenting plan. If they cannot agree, a court can decide. A lawyer can explain your options, help you prepare a realistic proposal, and represent you in negotiations or in court.
In most cases child support follows the child support guidelines. The amount is based mainly on the paying parent’s income, the number of children and the parenting arrangement, and it may include a share of certain expenses such as child care or medical costs. Support can be changed later if circumstances change significantly. A lawyer can explain what may apply to your situation.

Call (289) 406‑0110There is no automatic entitlement to spousal support. It depends on factors such as the length of the relationship, each spouse’s income and ability to earn, the roles each person played during the relationship, and financial need. The Spousal Support Advisory Guidelines give ranges that lawyers and courts often consider, but they are not a guarantee. A lawyer can advise you based on your circumstances.
For married spouses in Ontario, the matrimonial home is treated differently from other property. Both spouses generally have an equal right to live in it, regardless of whose name is on title, until a separation agreement or court order says otherwise. Other property is usually dealt with by calculating each spouse’s net family property under Ontario’s Family Law Act, and the spouse with the higher amount generally makes an equalization payment. Unmarried couples are treated differently, and strict time limits apply, so get advice early.
A separation agreement is a written contract that records how you and your spouse will deal with parenting, support and property after separating. The law does not require one, but a properly prepared agreement can bring certainty and avoid court. Each spouse should get independent legal advice before signing, because an agreement can be hard to challenge later.
Fees depend on the work involved. A straightforward agreement or uncontested divorce usually costs far less than a contested matter that involves negotiation, financial disclosure or court appearances. Some lawyers charge a fixed fee for straightforward work and others bill by the hour with a retainer. At Badesha Law, your free consultation includes a clear explanation of how fees and retainers work for your situation, so you know what to expect before you decide.
Call (289) 406-0110 to speak with our team and arrange a free, confidential consultation. You do not need anything to call. If you have them, these help us give you a clearer picture: your marriage certificate and the date you separated, recent income information, details of your home, savings, pensions and debts, your children’s names and ages, and any agreements or court documents you have received. You can also use the form at the top of this page or email info@badeshalaw.com, but for anything urgent or sensitive, please call.
Whether you are separating, dealing with a parenting dispute or need advice on support or property, our lawyers can help you understand the legal process and your next steps.
