Why Work With Us

Resolution First. Built Around Your Plan.

Badesha Law was started by Harprit Singh as a sole practitioner firm. Today the firm is a team of three lawyers, two law clerks and an office manager, with offices in downtown Toronto and Brampton.

We focus on resolution first. Family law matters are personal, and the right path depends on what you are trying to achieve. We start with your goals, then plan the most practical route to them, and prepare to go to court whenever that is what it takes.

We help you define the result you want and how you want your case handled, whether that is an agreement, mediation or court.

  3. We Explain How We Make It Happen

Then we explain, in plain language, how we can make it happen, what it involves and what it costs, so you decide with a clear picture.

Your options

Ways to Resolve Your Matter

There is more than one way through a family law matter. We explain each option, then recommend the route that fits your goals.

  1. Negotiation and Agreement

Your lawyer negotiates with your spouse or their lawyer to reach terms on parenting, support and property. Many matters are resolved this way, and the result is recorded in a written agreement.

Suits you when you and your spouse can reach terms, even if it takes lawyers to carry the conversation.

  2. Mediation

A neutral mediator helps you and your spouse work toward your own agreement. Your lawyer prepares you for the process and advises you on any proposal before you sign.

Suits you when you want a say in the outcome and a more cooperative process.

  3. Court

If issues cannot be agreed, a judge decides. We prepare your case carefully and represent you at each step, and settlement discussions often continue along the way.

Suits you when issues are in dispute, a court order is needed, or safety is a concern.

Not sure which route fits? We will walk you through it.

Toronto · Divorce

Not Sure Where To Start?

Separating or divorcing raises a lot of questions at once. A Toronto family lawyer can explain the process, your rights and what to deal with first, so you have a clear plan.

  1. Clear First Steps

We explain what to do first, what can wait, and which time limits may apply to you.

  2. Plain-Language Guidance

No legal jargon. You understand each step before you take it.

  3. A Free, Confidential First Call

Talk through your situation at no cost and with no pressure to commit.

What We Help With

  • Separation and divorce applications, whether joint or contested
  • Deciding what to do first when you separate
  • Temporary arrangements for the children, support and the home
  • Uncontested divorce paperwork, prepared and filed for you
  • Responding if your spouse has already started a case
  • Planning your finances and housing after separation

Good to Know

  • Separation does not need a court filing. Spouses can be separated while still living under one roof.
  • A divorce is a separate legal step. It requires the marriage to have broken down, most often shown by living separate and apart for at least one year.
  • Time limits can apply to some claims, so it helps to get advice early.

General information only, not legal advice. Your situation is specific, so please speak with a lawyer.

Toronto · How it works

What Happens When You Hire Us

No pressure and no obligation. Here is the process from your first call to resolution.

  1. Free Consultation

Tell us about your situation by phone, by video or in person. A lawyer explains your options and the process.

  2. Your Plan and Fees

We set out the route we recommend and explain fees and retainers before you commit. You decide whether to go ahead.

  3. We Prepare

We gather the documents and financial information your matter needs, and keep your file organized.

  4. We Negotiate or Act

We negotiate on your behalf and, if needed, prepare and file court documents and represent you.

  5. Resolution

Your matter is settled by agreement or decided by the court, and we explain the final steps.

Fees depend on the work involved. A straightforward agreement generally takes less work than a contested matter, and your lawyer will explain what to expect.

What to Bring, If You Have It

  • Marriage certificate and your date of separation
  • Recent income information, such as pay stubs and tax returns
  • Details of your home, savings, pensions and debts
  • Your children’s names and ages
  • Any agreements or court papers you have received

You do not need anything to call. Bring what you have, and we will work out the rest together.

Who Works on Your File

  • LawyersGive you legal advice, negotiate for you and represent you in court.
  • Law clerksHelp prepare documents and keep your file moving.
  • Office managerHelps arrange appointments and answers your practical questions.

Three lawyers, two law clerks and an office manager work together, so your matter has a full team behind it.

Toronto · Parenting

What Happens To My Children?

Your children come first, and so does a practical plan for them. We help you understand parenting time and decision-making responsibility, and work toward arrangements that reflect your children’s best interests.

  1. Parenting Plans That Work

We help you propose realistic schedules for school, holidays and everyday life.

  2. Child-Focused Advice

Parenting decisions are guided by the best interests of the child, and we keep that front and centre.

  3. Support If It Is Contested

If you cannot agree, we represent you in negotiations, mediation or court.

What We Help With

  • Parenting plans and schedules for school, holidays and vacations
  • Decision-making on education, health care and other major issues
  • Changing an existing parenting order or agreement
  • Moving or relocating with the children
  • Travel with the children, including outside Canada
  • Enforcement when parenting terms are not being followed

Good to Know

  • Under the Divorce Act, “custody” and “access” have been replaced by “parenting time” and “decision-making responsibility”.
  • Decisions are based on the best interests of the child, looking at the child’s needs rather than a parent’s preferences.
  • Parents are expected to consider resolving disputes outside court where it is appropriate and safe.

General information only, not legal advice. Your situation is specific, so please speak with a lawyer.

Toronto · Support

How Will Support Work?

Child and spousal support depend on income, parenting arrangements and your circumstances. We explain what may apply to you and how it is calculated, so you can plan ahead.

  1. Understand the Numbers

We explain how support is calculated under the guidelines and what that could mean for you.

  2. Financial Disclosure Reviewed

We examine income and financial information carefully so nothing is overlooked.

  3. Changes and Enforcement

Advice if circumstances change, or if support is not being paid.

What We Help With

  • Child support under the support guidelines
  • Spousal support, including how long and how much
  • Reviewing income, including self-employed and variable income
  • Sharing of child care, medical, education and activity costs
  • Changing support when income or circumstances change
  • Enforcement when support is not being paid

Good to Know

  • Child support belongs to the child, and parents generally cannot agree to give it up.
  • There is no automatic right to spousal support. It depends on factors such as the length of the relationship, income and need.
  • Support is based on full and honest financial disclosure from both sides.

General information only, not legal advice. Your situation is specific, so please speak with a lawyer.

Toronto · Property

What About Our Home and Finances?

The family home, savings, pensions, a business and debts all need to be dealt with. We explain how Ontario law treats them and what you may be entitled to or responsible for.

  1. The Family Home

We explain the special rules for the matrimonial home, whoever’s name is on title.

  2. The Full Financial Picture

We help gather and review disclosure of assets, pensions and debts.

  3. Equalization Explained

We explain net family property and equalization in plain language.

What We Help With

  • The matrimonial home, whoever’s name is on title
  • Calculating net family property and equalization
  • Pensions, RRSPs, savings and investments
  • Businesses and self-employed income
  • Debts, including who is responsible for what
  • Property rules for common-law partners

Good to Know

  • Equalization under Ontario’s Family Law Act applies to married spouses. Common-law partners are treated differently.
  • Both spouses generally have an equal right to stay in the matrimonial home, regardless of who owns it.
  • Strict time limits apply to property claims, so do not wait to ask.

General information only, not legal advice. Your situation is specific, so please speak with a lawyer.

Toronto · Agreements

Need Something in Writing?

A properly prepared agreement can bring certainty and avoid court. Whether you need one drafted or were handed one to sign, we explain what it means before you commit.

  1. Separation Agreements and Marriage Contracts

Drafted and negotiated to cover parenting, support and property.

  2. Review Before You Sign

We go through every clause and tell you what is fair, what is missing and what to push back on.

  3. Independent Legal Advice

Advice so that you understand your rights and obligations before you sign.

What We Help With

  • Separation agreements covering parenting, support and property
  • Marriage contracts and cohabitation agreements
  • Reviewing an agreement you have been asked to sign
  • Independent legal advice before you sign
  • Negotiating changes to a draft agreement
  • Updating an existing agreement

Good to Know

  • You do not need to be in a court case to sign an agreement.
  • Take your time. An agreement signed without advice can be hard to undo.
  • An agreement can be challenged later in some cases, for example if one spouse did not disclose significant assets or debts.

General information only, not legal advice. Your situation is specific, so please speak with a lawyer.

Toronto · Court

What If It Goes To Court?

Most matters settle without a trial, but some cannot. If yours is contested, or you have been served with court papers, we are prepared to protect your rights at every step.

  1. Served With Papers?

We explain what the documents mean, your deadlines, and how to respond.

  2. Prepared Representation

We prepare your case carefully and represent you in negotiations, conferences, motions and, if needed, trial.

  3. We Will Fight For You

If a fair resolution is not possible, our team is prepared to go to court to protect your rights.

What We Help With

  • Responding to court papers you have been served with
  • Motions for temporary parenting and support orders
  • Case conferences, settlement conferences and trial management
  • Financial and document disclosure
  • Trial preparation and representation at trial
  • Changing or enforcing an existing court order

Good to Know

  • A court case usually moves through an application and answer, then conferences, and only then a trial if issues are still unresolved.
  • If you have been served, a response deadline applies. Contact a lawyer promptly.
  • Settlement discussions often continue throughout the case, so many matters resolve before trial.

General information only, not legal advice. Your situation is specific, so please speak with a lawyer.

Toronto · Common questions

Frequently Asked Questions About Family Law in Toronto

General information only. Your situation is specific, so please speak with a lawyer about your circumstances.

What does a family lawyer in Toronto do?

A family lawyer advises on the legal issues that arise when a relationship ends or a family changes, including divorce, parenting arrangements, child and spousal support, dividing property, and separation or marriage agreements. A lawyer can explain your rights, help you negotiate, prepare and file court documents, and represent you in court if it becomes necessary. An experienced family lawyer can protect your rights at every step.

When should I speak with a family lawyer?

Ideally before you make major decisions, such as moving out, signing an agreement or agreeing to a parenting schedule. Early advice helps you understand your rights and obligations, and strict time limits can apply to some claims. It is also wise to call if your spouse has already hired a lawyer, if children are involved, or if you are worried about your safety.

Does every family law matter end up in court?

No. Many family law matters are resolved through negotiation, mediation or a written agreement, without a trial. Court becomes necessary when issues such as parenting, support or property remain in dispute, and even then many cases settle along the way. A lawyer can explain what to expect in your situation.

How do I file for divorce in Ontario?

A divorce application is filed with the Ontario Superior Court of Justice under the federal Divorce Act. At least one spouse must have lived in Ontario for at least one year before filing, and you must show that the marriage has broken down, most often because you have lived separate and apart for at least a year. You can apply on your own or jointly with your spouse, and a lawyer can prepare the documents and file them for you.

How are parenting arrangements determined?

Parenting decisions are guided by the best interests of the child. Under the Divorce Act, the terms parenting time and decision-making responsibility have replaced custody and access. Many parents agree on arrangements through negotiation, mediation or a written parenting plan. If they cannot agree, a court can decide. A lawyer can explain your options, help you prepare a realistic proposal, and represent you in negotiations or in court.

Still Have Questions? Book a Free Consultation.

Call (289) 406‑0110
How much does a family lawyer cost in Toronto?

Fees depend on the work involved. A straightforward agreement or uncontested divorce usually costs far less than a contested matter that involves negotiation, financial disclosure or court appearances. At Badesha Law, your free consultation includes a clear explanation of how fees and retainers work for your situation, so you know what to expect before you decide.

How is child support determined?

In most cases child support follows the child support guidelines. The amount is based mainly on the paying parent’s income, the number of children and the parenting arrangement, and it may include a share of certain expenses such as child care or medical costs. Support can be changed later if circumstances change significantly. A lawyer can explain what may apply to your situation.

Can I get spousal support, and how is it decided?

There is no automatic entitlement to spousal support. It depends on factors such as the length of the relationship, each spouse’s income and ability to earn, the roles each person played during the relationship, and financial need. The Spousal Support Advisory Guidelines give ranges that lawyers and courts often consider, but they are not a guarantee. A lawyer can advise you based on your circumstances.

What happens to our home and property?

For married spouses in Ontario, the matrimonial home is treated differently from other property. Both spouses generally have an equal right to live in it, regardless of whose name is on title, until a separation agreement or court order says otherwise. Other property is usually dealt with by calculating each spouse’s net family property under Ontario’s Family Law Act, and the spouse with the higher amount generally makes an equalization payment. Unmarried couples are treated differently, and strict time limits apply, so get advice early.

What is a separation agreement, and do I need one?

A separation agreement is a written contract that records how you and your spouse will deal with parenting, support and property after separating. The law does not require one, but a properly prepared agreement can bring certainty and avoid court. Each spouse should get independent legal advice before signing, because an agreement can be hard to challenge later.

Who will work on my file at Badesha Law?

Badesha Law was started by Harprit Singh as a sole practitioner firm. Today the firm has three lawyers, two law clerks and an office manager, so your matter has a team behind it. When you call, we explain who will be involved and how we will keep you updated.

Is the first consultation really free, and do I have to hire you?

Yes. The first consultation is free and confidential, and there is no obligation to hire us. You can ask questions, understand your options and decide afterward.

Can I meet by video or outside business hours?

Yes. We offer video consultations as well as in-person meetings, and evening and weekend appointments are available. Call (289) 406-0110 to arrange a time that suits you.

Will what I tell you stay confidential?

Yes. What you tell a lawyer when seeking legal advice is confidential and protected by solicitor-client privilege, with limited exceptions set by law.

How long will my matter take?

It depends on how much you and your spouse can agree on, how complex your finances are, and court schedules. Matters that settle by agreement are generally faster than contested matters that go through court. At your consultation, a lawyer can explain the likely steps and what affects timing in your situation.

My spouse already has a lawyer. Should I get one too?

In most cases, yes. Your spouse’s lawyer represents only your spouse, not you, so it helps to have your own advice before you agree to or sign anything.

What if I am worried about my safety?

If you are in immediate danger, call 911. If you are concerned about your own safety or your children’s safety, tell us when you call so we can explain the legal protections and options available to you.

How do I speak with a Badesha Law family lawyer in Toronto?

Call (289) 406-0110 to speak with our team and arrange a free, confidential consultation. You do not need anything to call. If you have them, these help us give you a clearer picture: your marriage certificate and the date you separated, recent income information, details of your home, savings, pensions and debts, your children’s names and ages, and any agreements or court documents you have received. You can also email info@badeshalaw.com, but for anything urgent or sensitive, please call.
