How Property Division Works in Ontario
Ontario’s Family Law Act does not split every asset in half. Instead, married spouses share the growth in their wealth through an equalization of net family property. Most cases settle through negotiation: one spouse keeps an asset and compensates the other, or the asset is sold and the proceeds divided. A clear separation agreement records the result.
What Is Net Family Property?
The Matrimonial Home in a Brampton Divorce
The family home follows special rules. You cannot deduct its value on the date of marriage, both spouses have an equal right to live there, and neither can sell or mortgage it without consent or a court order. A court may grant one spouse exclusive possession, which affects who lives there but not who owns it. Because children’s needs matter here, we coordinate with your parenting plan.
Excluded Property and Special Assets
Pensions are valued under special rules, business interests need expert valuation, and debts reduce net family property without making you liable to your spouse’s creditors. Full financial disclosure is mandatory, and hiding assets can lead to agreements being set aside. Our complex divorce team can help trace hidden assets.
Gifts or inheritances from third parties received during the marriage
Personal injury damages and life insurance proceeds
Property traced to excluded assets, except the matrimonial home
Property excluded by a marriage contract
Why Work With a Property Division Lawyer in Brampton?
Time Limits for Equalization Claims
Claims must be made within 6 years of separation or 2 years of divorce, whichever comes first. If a spouse dies, the survivor has 6 months to elect in writing. In rare cases, a court can order an unequal division under section 5(6) when equal sharing would be unconscionable. Common law partners have no automatic property sharing and must rely on claims such as unjust enrichment. Book a free consultation to protect your share.
